Gender Justice in Inheritance Distribution Practices in South Aceh, Indonesia

This paper explores the practices of inheritance distribution among people South Aceh who commonly divide property based on customary law. Heirs receive their shares not according to Islamic law (furudh al-muqaddarah), as both male and female heirs earn equal portions. The study this aims examine concept from perspective gender equity, pattern interaction formation in social institutions, basis for community beliefs dividing custom culture Aceh. obtained data by observing conducting in-depth interviews with figures, representatives Ulema Consultative Assembly (Majelis Permusyawaratan Ulama/MPU), judges at Tapaktuan Sharia Court using an empirical juridical approach. results revealed that has been alternative line principle justice women a manifestation balanced justice. reflected patterns through respective mechanisms accordance agreement all heirs. have preferred it more flexible taken into account socio-economic conditions values developed community.
